At Kelley & Canterbury, caring for clients is a family business. Michaela's father, Leonard “Len” Kelley, founded the firm in 1975 and was proud to help injured Alaskans for more than 45 years. Reshaping Case Law
The firm has handled cases big and small, taken matters before the Alaska Supreme Court, and reshaped case law. A few of our most notable decisions include:
- USAA v. Pruitt ex. Rel. Pruitt 38 P3d 528 (AK 2001) where an insurer appealed a trial court’s orders that apply an hourly rate on a bifurcated case of coverage and bodily injury claims. The Alaska Supreme Court unanimously approved, with Justice Matthews writing that attorney’s fees at an hourly rate when hired on contingency are justified.
- Sidney v. Allstate Insurance Company 187 P.3d 443 (AK 2008), which applies the common fund doctrine to automobile insurance subrogation claims.
- Noffke v. Perez 178 P.3d 1141 (2008). The defendant appealed a trial court jury verdict of various evidentiary rulings that resulted in a jury verdict in favor of Mr. and Mrs. Perez. In a unanimous decision, the Alaska Supreme Court held that the trial court did not abuse discretion by requiring a medical expert to produce tax returns to establish bias and that his exclusion at trial was appropriate.
